charuhasan | | There was this interesting news that an Afghan journalist threw two of his shoes at American President Bush and managed to bounce one of them of President Bush’s person. This took me back to my lawyer days to examine a number of cases where in my clients were charged under sec 355 of the penal code for using a chappal as a weapon of offence. That would be an offence of using force with intent to dishonor a person. I was also impressed by the fact that Actor Chiranjeevi’s dissenters throwing rotten eggs at him instead of an RDX bomb which was the culture of Andhra Pradesh till recently. I really appreciate the sophistication that came from the West in the matter of using force to dishonor a person without seriously damaging his anatomy. While using a chappal for the assault might cause minor skin abrasions while the throwing of an egg is less offensive unless rotten eggs are chosen. If the eggs or not rotten and are reasonably edible the insult intended less than by use of rotten eggs unless the victim is a vegetarian who does not consider even good eggs as not edible.
The moral of the Afghan story is a sole in hand is worth two thrown at Bush.

Ritu | | In India vegetarians don't eat eggs...vegans (who don't consume dairy products) are not so common in India...I've never come across any personally.
Why should throwing shoes at Bush be treated any different from throwing shoes at a common folk?? ( I guess that is a tort n not a crime)...what happened to equality before Law n all the jazz?? Also reminds me of a question that Shwetha put up earlier...is B punishable if B beats A after A provoked him?? Bush gave that guy enuff provocation I guess!!Private Reply to Ritu |

charuhasan | | Ritu...! `Tort is not a crime' may be correct but intention to use force is not a tort and is punishable. When it contains men rea it becomes a crime. Tort is any act which carries a liability for damages including a crime and an unintentional failure to do a duty.

Avinash Gowardhan | | There is a lighter side to this story.... After this incident, fifty percent Iraqis favored to call the journalist a hero as he succeeded in fulfilling their dream, the remaining fifty percent favored a punishment just because he missed the target.Private Reply to Avinash Gowardhan |
