Illegal gratification and bribery as the common parlance terms for favor taken in cash and kind by public servants. Under the Prevention of Corruption Act both giver and taker are guilty. (Subject to correction)
One gentleman got into the witness box and took an oath on a tribal God and stated that he received from the Prime Minister of India 50 Lakhs to vote in his favor in parliament.
The P.M. was sentenced to two years imprisonment and the man who received 50 lakhs was prosecuted by Indian police for murdering his private secretary in a dispute for sharing the corruption fee. The man who stated on oath that he received illegal gratification became a central minister and now he is a chief minister of a state.
Now my question is ‘If a man pays an Indian Public servant rupee 1/- to get a favor outside India is he guilty where Indian law does not apply?”
Another common sense question “Did a Prime Minister of India need to take 60 crores for supply of guns while her mother is said to have phoned State Bank of India hand over one tenth of the amount to be delivered by a State Bank Cashier 13 years back?
I spoke to a friend of mine who retired as Supreme Court and asked him about this and he told me that there is an international law that makes it a crime. I am a tired old lawyer and confused too… Lawyer Vijay..
Ask me questions. My answers could be wrong but could not be false….!

Ritu | | Charu, yes I'm a modern law graduate but I can't give you any lesson in law 'cos that would be like showing candle to the sun ( I look forwrd to receiving lessons from you on finer legal points & legal intricacies n I'm sure your answers would be right as well as true).....the question posed by you is interesting n I too look forward to the discussions on this thread.

charuhasan | | It is time that the younger generation reworte the laws. If you read Manu, his community could commit certain acts with minor punishments while the other people not related to mr. Manu could be punished with fine or imprisonment till rise of court. Under Chennai law a lady should be allowed to say that the one boy is not born to her husband but he is my neighbour's son born in my womb.
A man should have his statue in the beach for defending his wife who ran away with another man soon after marriage to prove that the Rolex watch that she tried sell in the Burma bazar was really his and burn the whole of paris Corner.
